1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of Kaizonai (the “Service”), operated by SYNTERI Digital, a Georgia limited liability company (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

2. Description of Service

Kaizonai is a software-as-a-service platform that provides AI-powered lead generation, business intelligence enrichment, outreach generation, and workspace management for businesses and agencies.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription and Billing

Free Trial: New accounts may receive a 14-day free trial. A payment method is required to start the trial. You will be automatically charged at the end of the trial period unless you cancel before the trial ends.

Subscription: The Service is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis at the then-current rate.

Pricing: Current pricing is available at kaizon.online/pricing. We may change pricing with at least 30 days' advance notice.

No Refunds: All subscription fees are non-refundable. You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period. You retain access to the Service until the end of the period you have paid for.

5. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited commercial communications, or content that violates anti-spam laws (CAN-SPAM, GDPR, etc.)
  • Harass, threaten, or harm any person or entity
  • Violate any applicable law or regulation
  • Attempt to reverse engineer, decompile, or scrape the Service
  • Use the Service to compete directly with us
  • Share your account credentials with others

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Supabase (database), Google Places API (lead data), Hunter.io and Apollo.io (contact enrichment), and others. Your use of these features is subject to those services' own terms.

8. AI-Generated Content

The Service uses artificial intelligence to generate outreach messages, business analyses, and other content. You are responsible for reviewing and approving any AI-generated content before sending it. We make no warranty regarding the accuracy or appropriateness of AI-generated content.

9. Intellectual Property

The Service, including all software, designs, and content, is owned by SYNTERI Digital. You retain ownership of data you input into the Service. You grant us a license to use, process, and display your data solely for the purpose of providing the Service.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel at any time via the billing portal. Upon termination, your access to the Service will end at the end of your current billing period.

11. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Georgia.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
